(1) The inspector appointed in accordance with this paragraph shall submit a report to the office with his opinion after conducting the investigation. The office shall give a copy of such report to the applicant. If any shareholder requests to get a copy of such report, the office shall take the prescribed fee and give the copy.
(2) If it is found from the report given by the inspector according to sub-section (1) that any director, managing director, manager, employee or any other official of the company has knowingly caused loss to the company, defrauded the shareholders or creditors, committed forgery or committed any other illegal act. Regardless of what is written in the law, the office has to order the company to file a complaint against them on behalf of such a company. However, this provision shall not be considered as restricting the company or shareholders from other remedies available in accordance with the prevailing law.
(3) If it is believed that the company's work is being carried out under the responsibility of the director, managing director, manager, employee or any other official who performs the work as per sub-section (2), the office may suspend such director, managing director, manager, employee or official and take other measures. He can give the necessary instructions to the company to organize the business of the company through measures.
(4) Regardless of what is written in the prevailing law regarding evidence, any matter mentioned in the report submitted by the inspector in accordance with sub-section (1) and the facts expressed therein shall be accepted as evidence.
